Domestic violence
In Georgia, Domestic Violence is a serious offense punishable either as a misdemeanor or possibly as a felony. The case will likely be initially referred to Diversion, if you qualify for that program. If not, the case will be prosecuted in State Court by the Solicitor General’s Office, if it is a misdemeanor or in the Superior Court by the District Attorney’s Office, if it is a felony.
Such charges are taken very seriously by prosecutors and will not simply be dropped just because the alleged victim asks them to do so. In addition to jail or prison, conviction for Domestic Violence carries with it many other consequences. One can be placed on probation, required to pay large fines, submit to random drug testing, obtain an alcohol and drug and an anger management evaluation from a licensed counselor and report to probation on a monthly basis.
In addition, if you are not a citizen you may be subjected to immigration consequences.
It is vital that you contact an attorney when charged with a misdemeanor, as the consequences of going into court without the protection provided by someone dedicated to protecting you and your rights would be dire.
